Terms of Service

1. Operator and agreement

The service is operated by MAŃSKI s.r.o. By creating an account, purchasing a subscription or using the service, you agree to these Terms and acknowledge the Privacy Policy. If you do not agree, do not use the service.

2. Eligibility and account security

You must be at least 18 years old or have permission and supervision from a parent or legal guardian where permitted by law. You must provide accurate information, keep your account secure and notify us promptly of suspected unauthorised access.

3. Informational service—not medical care

Diet Scan is an informational nutrition-support service. It is not a medical device, does not diagnose, treat, cure or prevent disease, and does not replace a doctor, pharmacist or registered dietitian. It does not prescribe insulin, medication, treatment or a therapeutic diet.

Food assessments are based on available product information, user-entered data, estimated portions, photographs and versioned rules. They may be incomplete or wrong. “Suitable”, “limit” and “avoid” are support signals, not guarantees of safety or individual tolerance.

4. Allergies and food information

Never rely on Diet Scan as the sole source for allergen safety. Always check the original packaging, ingredient list, manufacturer information and professional advice. Product formulations, recipes and cross-contamination risks can change without notice.

5. Artificial intelligence and estimates

AI may recognise a meal, extract label information, estimate a portion or explain a result. AI output is probabilistic and must be confirmed by you before use. Estimates are not exact measurements. The rule-based health assessment remains subject to the limitations of the underlying information.

6. Free plan, subscription and renewal

Diet Scan offers a continuing Free plan. The functions and usage allowances currently available in the Free plan are shown in the application and may be updated without converting the Free plan into a paid subscription. Unless a different offer is shown at checkout, Premium costs €9.90 per month or €49.90 per year. The selected subscription renews automatically at the disclosed price until cancelled.

You may cancel at any time without a cancellation fee. Cancellation stops future renewal; access continues until the end of the current paid period. Charges already made are non-refundable except where mandatory law or a stated refund promise requires otherwise. Before paid checkout is activated, the price, currency, billing period and payment provider will be shown.

Before checkout, you must expressly confirm the price, billing period, automatic renewal, these Terms and your request for immediate access to the paid digital service. Use of the Free plan does not itself waive or remove any statutory withdrawal right. Where consumer law provides a withdrawal right for digital services, we will request the consent and acknowledgement required by applicable law before immediate performance begins. Nothing in these Terms limits non-waivable consumer rights.

Premium includes up to 210 complete analyses per monthly billing cycle. Annual members receive the same monthly allowance, reset each month. When that limit is reached, new complete analyses are paused, while the calorie diary, meal logging, history, saved analyses, symptom functions and health overviews remain available. Optional one-time analysis packs may be purchased at the prices shown at checkout.

Payments are processed by Stripe. Hosted checkout may offer payment cards, Apple Pay or Google Pay when supported by the customer’s device, browser, country and Stripe configuration. The final checkout displays the applicable price, billing period and tax before confirmation. Diet Scan does not receive or store full payment-card numbers.

7. Acceptable use

You may use the service only lawfully and for personal purposes. You must not misuse scans, bypass usage limits, attempt unauthorised access, upload illegal or harmful content, interfere with security, reverse engineer protected parts of the service, or use results to provide unlicensed medical care.

8. Your content and our intellectual property

You retain ownership of information and photographs you upload. You grant us a limited licence to process them only as necessary to provide, secure and improve the service in accordance with the Privacy Policy. Diet Scan, its software, design, rules and original content remain protected intellectual property of MAŃSKI s.r.o. or its licensors. World Emergency Card and SCALP3L references identify trust and professional relationships; they are not the product name.

9. Availability, changes and termination

We may update features, supported foods, rules and these Terms, suspend the service for maintenance, or restrict access needed to protect users and systems. Material changes will be communicated when required. You may stop using the service and request account deletion at any time.

10. Liability

To the fullest extent permitted by law, the service is provided without a guarantee that every product, estimate or result is complete, current or suitable for a particular person. We do not exclude liability that cannot legally be excluded, including liability for intentional misconduct, gross negligence, injury caused by our fault, or mandatory consumer rights.

11. Czech law and disputes

These Terms and the contractual relationship are governed by the laws of the Czech Republic. For consumers, this choice does not remove mandatory protection provided by the law of their habitual residence.

Courts of the Czech Republic have jurisdiction to the extent permitted by applicable law. Consumers may also have the right to bring or defend proceedings before courts designated by mandatory consumer-jurisdiction rules.
